Are magistrates elected? or appointed? It's a little off base to believe that someone wouldn't get re-elected based on that in NC considering the marriage amendment voting results.

Magistrates are appointed by a senior court judge.

so, in theory, a senior court judge can appoint magistrates that oppose same-sex marriages, and there is nothing the electorate can do about it. until they are up for election...every eight years.

These officials need to publicly "come out" as to who will or wont officiate same sex marriages. This way when the next elections are held they might just find themselves out of a job!

Yes, but what if your religious beliefs contradict that and you did not have to do it when hired? It is not fair to the employees who don't believe in gay marriage. That was not a part of the job when they took the job.

Shoot....I don't think I've ever had a job where the rule/regulations/procedures/my responsibilities didn't change over time. A job is dynamic & can change. If you don't like the changes, then you're always free to leave and find another job.

The job description of a magistrate is to uphold the constitution of the state.

So, that WAS part of the job when they took the job.

The magistrates job never changed.

The constitution of the state DID change.

If the magistrate feels that they can not uphold the constitution of the state, then they have the right to step down.

Where does the separation of church and state come into play? I totally disagree with "OUR" elected officials having a loophole based on religion to slide through. Consider the source of this thread as confusion reins in the mind of the author. Magistrates are now exempt from performing the service due to their religious convictions. Marriage licenses are issued only by the Register of Deeds and can be refused on the same grounds. I agree with Governor McCrory's veto. When elected and appointed officials take office they swear to uphold the Constitution of the State of NC, regardless of their religious beliefs. This law countermands our Constitution and should never have been adopted. I want the government out of my bedroom!

for those who are hired as Magistrate and refuse to issue license based on Religious Beliefs need to resign...we as taxpayers need those to do their job as prescribed ..... if not leave there is not room for theocracy in a State Run Office....this is not a Religious Run State....
